2. The offer

The e-commerce website and the online catalogue have been carefully compiled. However, it is possible that the information is incomplete, not up to date or contains material errors. Artistry shall not be bound by obvious errors or omissions in the offer. Artistry shall only be bound by a best efforts obligation. Artistry shall NOT be liable for any misprints or material errors. When the client has specific questions about e.g. colour, product, availability etc., we request the client to contact us via the contact form, by mail or by phone. Het aanbod geldt zolang de voorraad strekt en onder voorbehoud van Artistry die deze ten allen tijden kan aanpassen of intrekken. Artistry cannot be held responsible for any unavailability of a product. If an offer has a limited validity or is made under certain conditions, this will be explicitly mentioned in the offer.

Backordered product
When you buy a product in backorder this means that the product is not in stock at Artistry. The product can be ordered but will only be available for shipment or collection when it’s delivered again by our supplier. The time frame of the backorder depends on the delivery time of our suppliers.

Coupons
Coupons cannot be applied to discounted articles. Per item coupons work only when the item is not discounted. Per basket coupons work only when there are no discounted items in the shopping basket.

Promotions and discounts (online and physical shop)
Discounts and promotions are not valid when purchasing electro. Please take this into account during a promotion or discount period. For more information you can always mail us: info@artistry-beauty.be.

3. General terms and conditions for training courses

Definition of training centre:
Is the place where the training sessions will take place, unless otherwise notified. In this case the training centre is: Artistry Professional located at Frans Versmissenlaan 21, 2100 Deurne (Antwerp). The student is the person who registers by phone, email or in writing and pays the tuition fee for the course to be followed at the training centre.
Costs of training:
There are several costs associated with following a training course: tuition fee to be paid at the training institute before the start of the lessons.
Materials
No materials are included in the course fee.

Exam participation
The participation in 1 exam is included, multiple exams are not included.
Registration and reservation:
The registration and reservation of the student is only final when we have received full payment(*) of the course fee 48 hours before the start of the training. If payment is not made within the time specified, the reservation of a place in the training programme will be cancelled. Artistry reserves the right to cancel or reschedule a course without incurring any liability and without paying any compensation. If you wish to cancel the course, we can only refund the registration fee by means of a voucher.

Absent
Artistry commits itself to train you always according to the newest techniques. With the payment you agree with the proposed dates and hours and you commit yourself to respect these agreements. If you are absent without notice, there is NO possibility to reclaim your registration fee or to follow the course at another time, free of charge. If for some valid reason you cannot attend a class, please let us know in advance by e-mail: info@artistry-beauty.be ,enkel. Then we can do everything possible to offer you a new course date and reschedule the paid course.


Cancellation of training

The registration for a training course can only be cancelled if the cancellation is sent by SIGNAL LETTER at least 10 days before the start of the course. Only when these conditions are met can the registration fee be refunded. No other form will be accepted to claim a refund of the registration fee.
Liability:
The training institute is not liable for loss, damage or theft of objects/materials belonging to the student. All damage caused by the student to the building, infrastructure, etc., either deliberately or through negligence, shall be recovered at the expense of the student or his legal representative. The student is liable for damage, either deliberate or negligent, to clothing and/or property of third parties.
Copyrights:
The copyright on the course material provided by the training institute to the student is vested in the training institute. The material may therefore not be reproduced and/or made public by means of photocopy, microfilm or in any other way, without prior permission of the training institute.
House rules:
When registering for a training course, the student undertakes to attend all the classes belonging to the training course. The student undertakes to study the theory and to properly carry out the practical tasks that are imposed.

Examinations

You will find the date, location and time of your exam in the group discussion and this information will be sent by e-mail to the student. The exam must be taken within 6 months after following the basic training.
The exam always takes place at Artistry in the classroom at the address Frans Versmissenlaan 21, 2100 DEURNE.
You always have to be present on time before the start of the exam and the models that might be provided for the practical part have to be present on time.
If you are late you can participate up to 10 minutes after the starting time provided that it is organisationally feasible. Please note that you will not be given extra time to take the exam. In the case of a preparation exam, the time you are late will be deducted from your preparation time.
Taking the exam is not a guarantee that you will go home with a Certificate. At Artistry we are only prepared to deliver a certificate to our students if they meet our standards and have had sufficient practice and results during their training.

4. Complaints

The Entrepreneur shall have a sufficiently notified complaints procedure and shall handle the complaint in accordance with this complaints procedure.Complaints about the implementation of the agreement shall be submitted to the Entrepreneur in a complete and clearly described manner within 7 days, after the Consumer has discovered the defects.Complaints submitted to the Entrepreneur shall be answered within a period of 14 days, calculated from the date of receipt. If a complaint requires a foreseeably longer processing time, the entrepreneur will respond within the period of 14 days with a notice of receipt and an indication of when the consumer can expect a more detailed answer.If the complaint cannot be solved in joint consultation, a dispute arises that is susceptible to the dispute. In case of complaints, a consumer should first turn to the entrepreneur.

5. Online purchases

The ordering procedure is as follows: The customer places the items in his/her shopping cart, then clicks through to the ‘checkout’ where an overview of the shopping cart is displayed. The confirmation is done via the e-mail address that the customer has specified. Then the customer chooses the shipping and payment option. Finally, the customer accepts the general terms and conditions and the sales contract is concluded:

Artistry shall be entitled to refuse an order in the event of serious negligence on the part of the Client with respect to orders involving the Client.
*When purchasing online courses please always indicate CLEARING IN THE STORE. If you do not do this, shipping costs will be charged on your invoice.
*With purchases via the webshop, the customer receives a gift (*with purchases from € 75 ex.) This only applies to purchases via the website, not in our physical shop.

6. Warranty

Under the Act of 21 September 2004 on the protection of consumers in respect of the sale of consumer goods, the consumer has legal rights. This legal guarantee applies from the date of delivery to the first owner. In order to make a claim under the guarantee, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods. For items purchased online and delivered to the client’s home, the client must contact Artistry and return the item to Artistry at his/her expense. If a defect is detected, the client shall inform Artistry as soon as possible. Any defect must be reported within 7 days of its discovery by the client. The warranty (commercial and/or statutory) shall never apply to defects which occur as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, alterations or modifications to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use. Defects that become apparent after a period of 6 months following the date of purchase, or delivery if applicable, are not considered to be hidden defects, unless the customer can prove otherwise.

8. The price

All prices stated are expressed in euros, and are always inclusive and exclusive of VAT and all other duties or taxes that the customer is required to pay. During the period of validity mentioned in the offer, the prices of the products and/or services offered shall not be increased, except for price changes as a result of changes in VAT rates. In case delivery-, reservation- or administrative costs are charged, this will be mentioned separately. All products are shipped by Artistry. Costs will be charged for this shipment. Notwithstanding the previous paragraph, the operator offers products or services whose prices are subject to fluctuations in the financial market and over which the operator has no influence, with variable prices. This link to fluctuations and the fact that any prices mentioned are recommended prices will be stated with the offer. Price increases within 3 months after the conclusion of the agreement are only allowed if they are the result of a legal regulation or provision. The price stated refers exclusively to the articles as described verbatim. The accompanying photos are for decorative purposes only and may contain elements that are not included in the price.

9. Right of withdrawal

The provisions of this article shall apply only to clients who purchase items online or from Artistry in their capacity as consumers.The client has the right to withdraw from the contract within a period of 14 calendar days without giving any reason.The withdrawal period will expire 14 calendar days from the day on which the client or a third party designated by the client and other than the carrier acquires physical possession of the item.In order to exercise the right of withdrawal, the client must inform Artistry of his decision to withdraw from the contract by an unequivocal statement (e.g. written post or e-mail).In order to comply with the withdrawal period, the client must send his notice of exercise of the right of withdrawal before the end of the withdrawal period. Opened products cannot be exchanged, as well as liquids or products without original sealing can NOT be exchanged. If the returned product has lost value in any way, Artistry reserves the right to hold the client responsible and to claim damages for any loss of value of the goods due to the use of the goods by the client beyond what is necessary to establish the nature, characteristics and operation of the goods. 10. Retained ownership

The delivered products remain the exclusive property of Artistry until full payment by the client.
The client undertakes, if necessary, to inform third parties of Artistry’s retention of title, e.g. anyone who may seize articles which have not yet been paid for in full.

11. Delivery and performance of the contract 

Articles ordered from our web shop are delivered in Belgium. Delivery is made by an external parcel service, for which the customer pays additional costs, as mentioned in the order procedure. Delivery to other countries than Belgium always has higher shipping costs. The goods will be delivered within 30 days after receipt of the order to the address or post office of the customer, unless otherwise specified. Any visible qualitative deficiency and/or damage or other shortcomings upon delivery must be reported by the client to Artistry (by email) within 12 hours of receipt. The risk of damage or loss shall pass to the client as soon as he or a third party appointed by him, other than the carrier, has received physical possession of the goods. However, the risk shall already pass to the client upon delivery to the carrier, if the carrier has been instructed by the client to transport the goods and the choice was not offered by Artistry.

12. Penalties for non-payment

Without prejudice to the exercise of any other rights available to Artistry, in the event of non-payment or late payment, the client shall be liable, automatically and without notice, to interest of 10% per annum on the unpaid amount, with a minimum of €25 per invoice. In addition, the client shall be liable, ipso jure and without notice, to lump sum compensation of 10% of the amount involved, with a minimum of €25 per invoice. Without prejudice to the above, Artistry reserves the right to take back articles which have not been paid for (in full).

13. Affecting validity – non-renunciation 

The failure at any time by Artistry to enforce any of the rights set forth in these terms and conditions or to exercise any of them shall not be construed as a waiver of such provision nor shall it affect the validity of these rights.

14. Change of conditions 

These conditions are supplemented by other conditions which are explicitly referred to, and Artistry’s general conditions. In case of contradiction, the present conditions shall prevail.

15.Cancellation/NO SHOW

Due to an increase in cancellations, the Artistry Team has decided to tighten its policy.
Artistry will inform the client about the financial consequences in case of modification and/or cancellation of the treatment.
The client must notify Artistry as soon as possible of any absence for an appointment, at least 24 hours prior to the start of the appointment.
CANCELLATIONS ONLY ON ARTISTRY’S PHONE: (+32) 034348381 or 0489593568. We can only be reached during our opening hours, please take this into account.
Messages (SMS)/mails/social media chats, these channels are not used to communicate a cancellation.
You will receive an automatic email 24 hours before the appointment as a reminder. Answering this mail is not a valid cancellation if it has to be done by phone.
If the client does not respect this obligation, Artistry will charge 50% to 100%* of the booked treatment.
If the client cancels an appointment within 24 hours before the appointment, the same financial consequences will apply.
If the client does not show up (NO SHOW) on a scheduled appointment, 50% to 100%* of the booked treatment will be charged. The client will receive an invoice by mail or by registered mail in case of negligence.
In case of non-payment, the client will receive a second reminder.
If the client remains negligent, Artistry will take further steps.
If the client arrives at the studio more than five minutes later than the agreed time, Artistry may deduct the lost time from the treatment and still charge the full agreed fee.
If the client arrives more than fifteen minutes later than the agreed time, Artistry may cancel the appointment and charge the client 50% to 100% * of the amount of the booked treatment.
*In case of contamination or contact with high risk Corona: please cancel the appointment in time, if necessary with proper evidence to refute a no-show bill. Artistry bases itself on the quarantine obligations of the government. If the client cannot provide an official absence the client will be charged for the No-Show.

16. FREE SKIN ANALYSIS terms and conditions

At the start of a skin treatment programme or with the purchase of more than €150 in skin products, the amount of €65 is deducted. The skin analysis is then free of charge.
